These terms govern your use of the CPAP Analysis app ("the App"), operated by Fellbeck Ltd (Company No. 16944419). By using the App, you agree to these terms.
Description of Service
CPAP Analysis reads and visualises CPAP therapy data from ResMed SD cards on your iPhone. The App displays metrics including AHI scores, respiratory events, pressure data, flow rate, and SpO2/pulse oximetry readings.
Medical Disclaimer
CPAP Analysis is not medical advice. The App provides data visualisation for informational and educational purposes only. It is not intended to be, and must not be used as, a substitute for professional medical advice, diagnosis, or treatment.
- Always seek the advice of your doctor or qualified healthcare provider with any questions about your condition or treatment
- Never disregard professional medical advice or delay seeking it because of information displayed by this App
- This App is not designed for use in medical emergencies — call your local emergency services immediately if needed
- Continue to attend all scheduled appointments with your sleep medicine provider regardless of what the App displays
Not a Medical Device
CPAP Analysis has not been evaluated or approved by the FDA, MHRA, or any other regulatory body. It is a general wellness and informational tool, not a medical device. It does not diagnose, treat, cure, or prevent any disease or condition.
Data Accuracy
The App reads and displays data as recorded by your CPAP device. While we strive for accuracy:
- We do not guarantee the accuracy, completeness, or reliability of any data displayed
- Calculations performed by the App (such as AHI scores and trend analysis) may differ from those produced by your CPAP device manufacturer's software
- You should not rely on the App's data for clinical decisions
Subscriptions
CPAP Analysis offers subscription plans that unlock all features. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- Manage or cancel your subscription in iPhone Settings > Apple ID > Subscriptions
- All payments are processed by Apple through the App Store
- For refunds, contact Apple Support at reportaproblem.apple.com
- Prices may change for future billing periods; existing periods are not affected
License and Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes. You may not:
- Reverse engineer, decompile, or disassemble the App
- Redistribute, sublicense, or make the App available to third parties
- Use the App for any unlawful purpose
Privacy
Your privacy is important to us. Please read our Privacy Policy for details on how we handle your data. In short: your health data never leaves your device.
Intellectual Property
All content, design, and code in CPAP Analysis are the property of Fellbeck Ltd. Your CPAP therapy data remains your property — the App merely reads and displays it.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Fellbeck Ltd shall not be liable for any health outcomes, medical decisions, or clinical actions taken or not taken based on information displayed by the App
- Fellbeck Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Fellbeck Ltd shall not be liable for damages arising from inaccurate, incomplete, or misleading data, whether caused by errors in the source data, parsing, calculations, or display
- Fellbeck Ltd's total liability for all claims shall not exceed the amount you paid for the App in the twelve months preceding the claim
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify and hold harmless Fellbeck Ltd from any claims, damages, or expenses arising from your misuse of the App or your reliance on the App's data for medical decisions.
Termination
We may terminate or suspend your access to the App if you violate these terms. You may terminate by deleting the App. The following sections survive termination: Medical Disclaimer, Disclaimer of Warranties, Limitation of Liability, and Indemnification.
Governing Law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any disputes arising from these terms or your use of the App.
Changes to These Terms
We may update these terms from time to time. Material changes will be communicated through app update notes. Continued use of the App after changes constitutes acceptance of the updated terms.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force and effect.
